The Department of Justice lacks sufficient structural independence, external oversight, and enforceable safeguards to prevent presidential use of its leadership, personnel, investigative authority, and prosecutorial discretion for personal protection, political retaliation, or partisan advantage.

Issue Boundaries

• DOJ-002 owns preventive controls over case-specific White House and political contacts, including routing, logging, review, and preservation.
• DOJ-003 owns politically selective charging and noncharging together with independent OIG anomaly review and congressional reporting.
• DOJ-004 is paused pending merits adjudication of the Article II removal question presented by the Maurene Comey litigation.
• DOJ-005 owns senior-official recusal administration and enforcement.
• DOJ-007 owns independent investigation, evidence preservation, and congressional reporting when presidential or senior executive conflict makes ordinary DOJ accountability unreliable.
• DOJ-009 owns baseline professional eligibility, good standing, disciplinary disclosure, and post-appointment discipline consequences for senior DOJ legal offices.
• REG-002 owns case-specific executive influence over DOJ Antitrust and other noncriminal regulatory-enforcement matters; DOJ-002 and DOJ-003 remain limited to criminal investigation, prosecution, charging, and noncharging.

DOJ-001, DOJ-002, DOJ-003, DOJ-005, DOJ-007, and DOJ-009 are developed. DOJ-004 is substantively identified but intentionally held at Awaiting merits adjudication. DOJ-006 and DOJ-008 are retired as duplicative standalone issues, with their nonduplicative components preserved in the identified primary issues.
