A-11 — Executive Impoundment and Departure from Congressional Spending Decisions¶
Generalized Institutional Concern¶
The executive branch can implement policy beyond or contrary to Congress's enacted spending decisions by delaying, conditioning, redirecting, or refusing appropriated funds, while available enforcement mechanisms remain too slow, uncertain, or politically dependent.

Prior Issue Numbers¶
These numbers were assigned during preliminary review but did not become separate proposals. They are listed only to explain gaps in the sequence.
- FUND-003, FUND-005, FUND-006, FUND-007, FUND-008 — Merged into FUND-001 as program-nullification, reprogramming, standing, remedy, accountability, and reporting components of its fiscal implementation framework.
- EMERG-002 — Integrated into FUND-001 as the emergency-authority appropriation-redirection manifestation.
- FUND-004 — Merged into FED-003 for state and local funding coercion, with RET-001 retaining the cross-sector retaliation mechanism and FUND-001 retaining enacted-appropriation enforcement.
Issue Boundaries¶
- FUND-001 owns spending, nonspending, apportionment, reprogramming, transfer, program nullification, fiscal implementation of ultra vires executive directives, standing, remedies, accountability, and real-time GAO or congressional reporting.
- FUND-002 remains separate because pocket rescissions exploit expiration and release timing even without FUND-001's repeated-unlawful-directive trigger.
- FED-003 owns federal funding or benefit conditions used to compel state or local policy change; RET-001 owns retaliation through grants or other federal benefits across recipient classes.
Notes¶
FUND-001 remains 83/100 and Review Ready after a targeted consolidation review found that its current issue and standalone bill already cover the absorbed fiscal mechanisms. FUND-002 has a candidate issue framework. Further FUND-001 advancement requires qualified appropriations, federal-courts, budget, program-administration, and legislative-counsel review plus proposal-specific workload evidence and a current-litigation refresh before circulation.
